Man found guilty of manslaughter of young Townsville motorcyclist during 'high-speed' stolen car chase (2024)

In short:

Gregory Clubb has been convicted of the 2021 manslaughter of motorcyclist Jennifer Board.

The jury took just over two days to return the verdict in the Supreme Court in Townsville.

What's next?

Clubb is due to be sentenced in October.

A north Queensland jury has found a man involved in a fatal high-speed stolen car chase guilty of manslaughter.

Gregory Clubb, 22, has been on trial in the Supreme Court in Townsville charged with the unlawful killing of 22-year-old motorcyclist Jennifer Board in February 2021.

On the night of February 5, Clubb was being chased by vigilante driver Christopher Michael Hughes along Ross River Road in Townsville.

Clubb was driving a stolen car at the time.

Hughes lost control of his vehicle and veered onto the wrong side of the road when he struck and killed Ms Board on her motorbike.

Hughes is currently serving a 12-year prison sentence for Ms Board's manslaughter.

Clubb, who was 18 at the time, left the scene of the crash along with three other car passengers.

The jury deliberated for just over two days before returning the unanimous guilty verdict on Wednesday.

A spokesperson for the Board family said they were satisfied that justice had been served.

'Erratic' driving put lives in danger

During the five-day trial, crown prosecutor Andrew Walklate argued while Hughes' actions were the direct cause of Ms Board's death, Clubb's "erratic" driving put lives in danger.

"Had he [Clubb] not done the series of actions that he did, Jennifer Board would still be here today," Mr Walklate said.

"He caused her death."

In a police interview recorded in the days after the incident, Clubb said he had reached speeds of up to 180 kilometres per hour, at times, as the pair travelled from Rasmussen to Kirwan.

He said he would have taken "any risk" to avoid being caught acting like a vigilante.

"I don't care if I got to run over a police officer or anything … I don't care," Clubb said during his interview.

A senior technical officer from Queensland Police analysed CCTV of Hughes' car in the seconds before the crash.

The officer estimated Hughes was travelling between 108-133kph before hitting Ms Board.

Mr Walklate said he rejected the use of the term "vigilante" to describe Hughes, which has frequently been used during the trial.

"[They] are not crime fighters who act outside the law for a common good or to improve life," Mr Walklate said.

"What they have done, in conjunction with those who drive like Mr Clubb on that night, is make our roads unsafe."

Going '100 per cent throttle'

Multiple witnesses recounted how Hughes and Clubb weaved between lanes, narrowly missed other cars and ran red lights during the chase.

They also said their two vehicles came within "centimetres" of each other.

Forensic examination of both cars was unable to prove whether any collision had occurred, despite Clubb's account that Hughes had hit him in the rear bumper before losing control.

One witness told the court the two drivers were going '100 per cent throttle' down Ross River Road.

"Those cars were being pushed to their mechanical limits on a 60kph roadway, not on a race track," Mr Walklate said.

Mr Walklate said both men were known to each other and had engaged in road chases before, which proved Clubb was aware of the risks when he chose to swap places with his friend and sit in the driver's seat before the chase began.

"He [Clubb] wasn't fleeing, he was engaging," Mr Walklate said.

"He lives for this, he wanted this, he was getting off on it … He could have stopped but he didn't."

Defence arguments

Defence barrister Ross Malcomson said while Clubb's driving was "objectively dangerous" and "negligent", he rejected the idea that Clubb was involved in a high-speed "game".

He argued Clubb was trying to avoid being physically harmed by Hughes.

"It's not a competition, he was being chased, they're trying to get away," Mr Malcomson said.

"He was being chased by a person known to him to ram cars off the road and bash and inflict violence upon those that he stops."

In Clubb's police interview, the 22-year-old said he sped past a vehicle he knew to be an unmarked police car in an attempt to engage them to scare Hughes away.

"Criminal reasonability rests at the feet of Christopher Hughes and Christopher Hughes alone," Ms Malcomson said.

In his police interview, Clubb said he didn't know anyone had been hit and killed on the night and only found out Ms Board had been struck in the days after the incident.

The jury ultimately found Clubb guilty of manslaughter and he was remanded in custody.

He is due to be sentenced on October 23.
